TERMS OF SERVICE.

Introduction

These Terms of Service govern the use of this website and any services provided by Shaan Roy ("I", "me", "my") through shaanroy.com or directly via communication channels such as WhatsApp, email, or Fiverr.

By contacting me, submitting a project request, or hiring me for any service, you agree to these terms. If you do not agree, please do not use my services.

Services Provided

I offer freelance WordPress-related services including but not limited to:

  • WordPress bug fixing and troubleshooting
  • Plugin conflict resolution
  • Website speed optimisation
  • Security fixes and monitoring
  • Contact form and SMTP configuration
  • Hosting and server management
  • Monthly website maintenance
  • Custom feature development and integrations

The scope of each project is agreed upon before work begins. Any work outside the agreed scope will be quoted separately.

Payment Terms

New clients: For first-time projects, I operate on a pay-after-satisfaction basis. You only pay once the issue is resolved and you are satisfied with the result.

Returning clients: Standard payment is required before or upon delivery, as agreed at the start of the project.

Accepted payment methods (direct): Payoneer, NSave, Remitly, TapTapSend, and direct bank transfer.

Via Fiverr: Payment is handled through Fiverr's platform and their payment terms apply.

All prices are quoted in USD unless otherwise agreed. Prices are final once confirmed. I reserve the right to adjust pricing for future projects.

Project Scope & Revisions

Each project has an agreed scope communicated before work begins. This includes what will be fixed, built, or configured.

  • Fixes are covered under the agreed price for the specific issue described
  • Additional issues discovered during work will be quoted separately unless minor
  • Reasonable revisions related to the original scope are included at no extra charge
  • Requests for new features or pages outside the original scope are treated as new projects

Fix Guarantee

I stand behind my work. If the same exact issue that was fixed reappears within 14 days of project completion, I will resolve it again at no additional charge.

This guarantee applies to the specific issue fixed and does not cover:

  • New issues unrelated to the original fix
  • Issues caused by client-made changes after project handover
  • Plugin or theme updates made by the client that introduce new conflicts
  • Third-party hosting or server changes outside my control

Client Responsibilities

To ensure smooth project delivery, the client agrees to:

  • Provide accurate and complete information about the issue or project
  • Grant necessary access (WordPress admin, hosting panel, etc.) in a timely manner
  • Maintain a backup of the website before granting access (I also take backups, but the client should have their own)
  • Respond to questions or requests within a reasonable timeframe
  • Not make changes to the website during active work without notifying me

Access & Confidentiality

Any login credentials, API keys, or sensitive information shared with me for the purpose of completing a project will be kept strictly confidential. I will not share, store unnecessarily, or misuse any credentials provided.

I recommend changing passwords after project completion as a standard security practice.

I always take a backup before making any changes to a live site. However, I recommend clients maintain their own independent backups.

Turnaround Time

Estimated turnaround times are provided at the start of each project and are not guaranteed unless explicitly stated as a deadline. Factors affecting delivery time include:

  • Complexity of the issue
  • Speed of client responses and access provision
  • Third-party dependencies (hosting, plugin developers, etc.)

Speed optimisation projects may take up to 7 days. Emergency/urgent requests are handled when schedule allows and may carry an additional fee.

Monthly Maintenance

Monthly maintenance plans are provided on a rolling monthly basis with no long-term lock-in. Either party may end the arrangement with reasonable notice (minimum 7 days before the next billing cycle).

The scope of each maintenance plan is agreed in writing before the plan begins. Any work outside the agreed plan scope is quoted separately.

Limitation of Liability

I take every reasonable precaution when working on client websites. However, I am not liable for:

  • Data loss resulting from pre-existing issues, hosting failures, or circumstances outside my control
  • Downtime caused by third-party hosting providers
  • Issues introduced by client or third-party changes after project handover
  • Lost revenue or business impact arising from website issues

My total liability for any claim is limited to the amount paid for the specific project in question.

Intellectual Property

Any custom code, scripts, or solutions I develop for a client become the client's property upon full payment. I retain the right to use anonymised project examples in my portfolio unless the client explicitly requests otherwise.

I do not claim ownership over any pre-existing content, themes, plugins, or assets belonging to the client.

Governing Law

These terms are governed by the laws of Bangladesh, where I am based. For EU-based clients, applicable GDPR and consumer protection regulations also apply.

Any disputes will first be attempted to be resolved through direct communication. If unresolved, disputes may be referred to the appropriate legal jurisdiction.

Changes to These Terms

I reserve the right to update these Terms of Service at any time. Changes will be reflected on this page with an updated date. Continued use of my services after changes constitutes acceptance of the updated terms.
